Florida homeowners could soon vote to dissolve their HOAs

· Source: Realtor.com

What’s happening

Florida lawmakers are weighing a bill that would give homeowners in a community a clearer path to dissolving their homeowners association by majority vote. Proponents frame it as a release valve for residents who feel trapped in HOAs with rising fees and aggressive enforcement. Critics — including many real estate attorneys — warn that dissolving an HOA can crater home values in neighborhoods designed around shared amenities (gates, pools, landscaping, private roads).

Why this matters if you’re buying

If you’re shopping in a Florida HOA community, this is worth tracking — but don’t make it your buying decision:

  • HOA risk is more about reserves than rules. The biggest financial surprise buyers hit in Florida is a community without enough money set aside for future repairs. Ask for the most recent reserve study and the audited financials before you make an offer.
  • Amenities drive value. If a community’s pool, gate, or clubhouse is what makes the comparables in your neighborhood sell, dissolving the HOA that maintains them is a value risk, not a value win.
  • Read the rules before you sign. The HOA disclosure package is required in Florida. Skim the rules, the fines schedule, and the meeting minutes for the last 12 months. That tells you what kind of HOA you’re joining.
